A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was held in federal custody.

In her decision, the court noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
